Chilly Time for Marc Jacob’s Autumn/Winter 2014 collection
Winter may be a little behind us, but Marc by Marc Jacob’s Autumn/Winter 2014 collection in the United States, which features a four stripe design vertically down the sleeves is causing a bit of a chill across the pond. Adidas, which is the owner of a number of trade mark registrations for its three stripes logo has recently filed for a claim against Marc Jacobs in the US Federal Court for alleged trade mark infringement. It would will be interesting to see how the court will decide whether Marc Jacob’s use of the mark will create a likelihood of confusion in the minds of the public and whether Adidas’ mark had been infringed, especially noting that in Europe, the General Court cancelled K-Swiss’ five stripe mark on shoes on the basis that it was not sufficiently distinctive. We are waiting to see just how broadly Adidas enjoys protection in its three stripe mark in the United States.
