In an article published in the September issue of The Journal of Intellectual Property Law & Practice, Désirée Fields looks at the recent decision in Simca v OHIM in which  the General Court reviewed the interpretation of the concept of "bad faith" and approved the cancellation of a CTM registration finding that the applicant had acted in bad faith when applying to register the mark.
