Review of United Kingdom Trade mark and Design Decisions from 2014
In this article for International Review of Intellectual Property and Competition Law, Julius Stobbs, Yana Zhou and Geoff Weller looked at key UK trade mark and design decisions from the past year that may be of particular interest to comparative lawyers: some interesting approaches to acquired distinctive character, with further guidance sought for shape marks; a continuation of the Adwords saga; a number of cases in the Intellectual Property Enterprise Court; a design case emphasising the importance of defining the right in the most appropriate way; a test case around Internet Service Providers blocking access to trade mark infringing websites; and a case involving the exploitation of the rights to a famous fictional character.
