In an article for this month’s CITMA Review, Carrie Bradley comments on the UKIPO’s decision in an opposition to the mark SNAIL MAIL, filed on the basis of earlier rights in MAIL ( O/436/17 ). The article notes that exclusions within specifications will not reduce the likelihood of confusion if other similar or identical broad terms remain, and comments on the risk of indirect confusion which arises where a later mark appears to be consistent with an earlier brand's logical expansion.
