Stobbs in the CITMA Review – Visii prompts revisitation
In an article for this month’s CITMA Review, Victoria Leach comments on the UKIPO's decision in an opposition filed against an application for the mark VISII ( O/263/17). The article notes that the Hearing Officer has the ability to propose a rewording of the specification, but that in doing so they must have regard to any proposal made by the trade mark owner, which can offer applicants a way of obtaining a registration for at least some of their goods and services when it looks like an opposition might otherwise be entirely successful.
