Between now and September 2015, foreign owners of registered Japanese trade marks can apply to the Manufactured Imports and Investment Promotion Organisation to be listed in their Directory of Foreign Brand Right Holders (the Directory), which is distributed to Japanese Customs and the police. Whilst registration within the Directory does not remove the need to apply to Japanese Customs for filing an import suspension motion, the benefits of becoming listed include the increased chances of counterfeit detection, brand identification and a clear channel of communication between brand owners and the authorities. The Directory is a welcomed and cost-effective tool for brand owners, complementing other counterfeiting measures and joining the brand enforcement dots. For those set to make their Directory debut, the time to act is now, whilst those already registered may wish to review their trade mark portfolio to identify any marks registered since publication of the 2014 Directory.
