Enhanced forms for Community Design filings
Enhanced forms for Community Design filings
The EU trade mark and design office have updated their online design filing platform to allow 3D images of a design from different camera angles to be uploaded in an application and boasts a “drag and drop” feature, where users can drag a .jpeg image from their computer and drop it in an image box on the system. These changes will hopefully allow designs to be more clearly defined in the visual sense and make the platform even more user friendly. Registered Community Designs can provide a useful avenue of protection for designs and brands (see recent H&M v YSL post here). Stobbs has extensive experience of obtaining and enforcing Community designs and other unregistered and registered forms of protection (including design applications through the Hague System (see our post here)).
