Last week the Court of Appeal (in England and Wales) (here) in Cartier v British Sky Broadcasting et al dismissed the appeals by the ISPs (internet service providers) against the High Court decision which ordered them to block or attempt to block customer access to certain websites which were advertising and selling counterfeit copies of (amongst others) Cartier’s goods.
As noted in our previous posts on these earlier cases (here), this is a big step forward for brand owners seeking to prevent the sale of counterfeit products that infringe their trade mark rights on the Internet.
