SHOULD’VE
A UK trade mark application involving no conflict with a third party very rarely makes the mainstream news. But last week the application at the UK Intellectual Property Office to register the mark “SHOULD’VE” in the name of Specsavers B.V caused significant interest in the media (see here in The Times and The Drum).

The series application for the word marks “SHOULDVE” and “SHOULD’VE” in classes 9, 10, 16, 35 and 44, (link here) has, at the day of posting, been accepted and is scheduled for publication for opposition purposes. Specsavers already owns an EUTM for “SHOULD’VE GONE TO SPECSAVERS” and UK readers cannot have missed the advertising featuring this slogan.

Slogans can be key parts of brand identity but it is not always straightforward to achieve trade mark registrations for them. Stobbs has significant experience in protecting these brand elements and if you have any questions please get in touch.
